[000.1-005.7] I find you not guilty of second degree murder is what the judge said to Interdeep Singh
[005.7-011.5] Gosal before announcing he was guilty of the lesser charge of manslaughter for stabbing
[011.5-015.2] and killing Paul Schmidt in March of 2023.
[015.2-020.8] What began as a verbal altercation over Gosal smoking on the patio of a West Pender Starbucks
[020.8-023.5] turned violent when Schmidt approached him.
[023.5-029.2] In reasons for sentencing, Justice Kathleen Kerr called CCTV video of the interaction
[029.2-032.8] the most compelling and objective evidence at trial.
[032.8-037.6] She called Schmidt agile and able and said he readily adopted a fighting stance when
[037.6-042.2] confronting Gosal who immediately pulled out a knife as Schmidt approached.
[042.2-047.8] Mr Schmidt confronted, punched at and started to corner Mr. Gosal, Justice Kerr said.
[047.8-051.6] She accepted Gosal's testimony that he feared for his life.
[051.6-056.5] Gosal would stab Schmidt six times before the victim collapsed in a pool of blood on
[056.5-057.5] the patio.
[057.5-060.7] Kerr said Gosal went too far.
[060.7-065.5] He was no longer acting in self-defense, but he was still acting in the heat of the moment,
[065.5-071.0] likely disinhibited and angry and responding to a situation where he perceived his life
[071.0-072.2] was in danger.
[072.2-076.4] A date has not yet been set for Gosal's sentencing hearing.
[076.4-081.1] He's already been in custody for three and a half years and could get additional credit
[081.1-085.4] for time served when his sentence is ultimately handed down.
